- Biological children of Canadians, and
- Non-biological children born outside of Canada with a legal parent-child relationship at birth (one of the parents must be Canadian)
Who is eligible to get Canadian Citizenship by succession?
The new definition given by Canada for “parent” considers all those individuals who have been identified as a child’s legal parent at birth. These Canadian parents can pass on Citizenship to their children with or without a biological connection. Canada will recognize these individuals as legal parents if their name appears on either of the below:- The child’s original birth certificate; or
- Other relevant records of the child’s birth (hospital records, surrogacy records, and court orders)
- None of his biological or legal parents is a Canadian citizen
Who will be automatically granted Canadian Citizenship?
It does not seem very clear that who will be automatically granted Canadian Citizenship and who is eligible to apply for Citizenship. However, to help individuals answer this question, the federal department of Immigration, Refugees and Citizenship Canada (IRCC) has introduced a tool called “Am I Canadian.” The IRCC says individuals are expected to be Canadian citizens if they:- Applied for and received Citizenship in the country;
- Were born in Canada (but not to foreign diplomats);
- Obtained Canadian Citizenship as a minor when a parent applied on their behalf;
- Became a Canadian citizen due to any changes in the country’s Citizenship Act;
- Were born abroad, but at least one of their legal or biological parents were Canadian citizens.
